If the FDIC was following the law, these banks would be over and done with. cooked as in T.O.A.S.T.

FDIC is a willing complicit in the cooking by not doing its job already.

I hope no one ever says, we are a nation of laws, even the failed notion of contract law. Seems TPTB only follow laws in their best interest to hell with the nation and even less for the nation's middle class citizens.

Is it possible that "they" are setting some of these up to be "fraud" rather than just ordinary losses that would typically be covered by FDIC insurance? Might explain the FBI involvement with Colonial .. Let the depositors at the mercy of the courts for recovery ?

This isn't some private phone call from Bair to a bank president asking them to try to start marking these loans a little closer to reality. This is in Marketwatch quoting the ORDER FROM THE FDIC THAT THE BANKS HAVE TO NOW START ACCURATE MARKING - EVERY QUARTER!!!

FDIC is under the mistaken belief that the banks follow the law even more importantly that the banks look on the FDIC website to see what the FDIC sez what the banks must do.

They are too busy cooking the books, shifting assets, and shredding the evidence too look on a website to see what FDIC has to say of late.

Is the FDIC afraid to confront the banks they have notify from a distance with sugary words on a website??

Is there a specific provision in the terms of the FDIC insurance that precludes FDIC backstopping customer moneys even if the institutions commit fraud?

It seems to me that the FDIC commitment is to the depositors, and is not an insurance for the financial institutions. In general, an insurer can get out of paying off on an insurance policy if the beneficiary of the policy engaged in fraud; in this case, the depositors generally did not.

disclosure: I am not a lawyer; I am looking at it from a common sense point of view. And yes, I understand that any relationship between the law and common sense is often purely coincidental.
